Welcome to The Memry. These Terms & Conditions ("Terms") govern your access to and use of The Memry website, customer accounts, services, and purchases.
The Memry is owned and operated by Metrosel Inc. References to "The Memry," "we," "us," or "our" in these Terms refer to The Memry and, where applicable, Metrosel Inc.
By accessing our website, creating an account, or placing an order, you agree to these Terms. If you do not agree with these Terms, please do not use our website or purchase our products.
1. ABOUT THE MEMRY
The Memry is a fragrance and personal care brand offering perfumes, body oils, body lotions, hand soaps, body washes, and other fragrance, bath, body, and personal care products.
Our online store is operated through the Shopify ecommerce platform.
2. ELIGIBILITY
You must be at least the age of majority in your state, province, territory, or country of residence to make a purchase from The Memry, or you must make your purchase with the involvement and consent of a parent or legal guardian.
You may not use our website, services, or products for any illegal or unauthorized purpose.
3. OUR PRODUCTS
We make reasonable efforts to accurately present our products, including their descriptions, ingredients, fragrance notes where applicable, sizes, packaging, photographs, and other product details.
Fragrance and personal care experiences can vary from person to person. Scent perception, fragrance longevity, and projection may vary depending on factors including skin chemistry, environment, temperature, application method, and individual perception.
Similarly, the feel, absorption, appearance, fragrance, and individual experience of body and personal care products may vary depending on skin type, environment, application, and individual use.
Fragrance note descriptions are intended to communicate the general character and composition of a scent. They do not guarantee that every individual will perceive each fragrance note in exactly the same manner.
Product colors, textures, liquid appearance, bottles, containers, labels, and packaging may appear slightly different due to photography, lighting, screen settings, production variations, ingredient variations, or packaging updates.
Minor variations that do not materially affect the intended use or quality of a product are not considered defects.
4. PRODUCT USE AND SAFETY
Our perfumes, body oils, body lotions, hand soaps, body washes, and other cosmetic and personal care products are intended for external use only.
Please use products only as directed and review any ingredient information, directions, precautions, and warnings provided with the product.
Avoid contact with eyes unless a product is specifically intended for use in that area. Do not ingest our products. Keep products out of reach of children and store them appropriately.
Perfumes and other alcohol-containing or flammable products should be kept away from flames, heat, sparks, and other ignition sources.
Individual sensitivities and allergies vary. If you have known allergies or sensitivities to fragrance, essential oils, cosmetic ingredients, or personal care products, please review available ingredient information before use.
Where appropriate, consider testing a small amount of a product before broader application. Discontinue use if irritation or an adverse reaction occurs and seek appropriate medical attention when necessary.

Our cosmetic and personal care products are not intended to diagnose, treat, cure, or prevent any disease.
5. PRODUCT AVAILABILITY
Products may be available in limited quantities and are subject to availability.
We may introduce, modify, discontinue, restock, reformulate, or change products or packaging at any time, subject to applicable law.
Adding an item to your shopping cart does not reserve inventory. Products may become unavailable before checkout is completed.
We reserve the right to limit quantities purchased when reasonably necessary, including to prevent fraud, unauthorized resale, abuse of promotions, or inventory shortages.
6. PRICING
Prices displayed on our website are shown in the currency presented during your shopping experience and are subject to change without notice.
Applicable taxes, shipping charges, duties, and other applicable charges will be disclosed during checkout where required.
We make reasonable efforts to ensure that pricing and product information are accurate.
If a material pricing or listing error occurs, we reserve the right to correct the error and, where legally permitted, cancel an affected order.
If payment has already been collected for an order that we cancel, the applicable amount will be refunded to the original payment method.
7. ORDERS
Submitting an order constitutes an offer to purchase the products in your order.
An automated order confirmation confirms that we have received your order. It does not necessarily mean that your order has been accepted, processed, or shipped.
We reserve the right, where reasonably necessary, to refuse, limit, or cancel an order due to suspected fraud, unauthorized payment activity, inventory errors, material pricing errors, abuse of promotions, unusually large quantities, suspected unauthorized resale, or other legitimate business reasons.
If we cancel an order after payment has been collected, we will refund the applicable amount.
Customers are responsible for providing accurate billing, shipping, contact, and payment information.
8. PAYMENTS
Payments are processed through the payment methods made available at checkout.
These may include Shopify Payments, major credit and debit cards, Shop Pay, Apple Pay, Google Pay, PayPal, and other payment methods that may be made available from time to time.
Payment providers may process your information according to their own terms and privacy practices.
The Memry generally does not directly receive or store your complete payment card number when payment information is processed by an authorized payment provider.
By submitting payment information, you represent that you are authorized to use the payment method provided.
9. PROMOTIONS AND DISCOUNT CODES
The Memry may occasionally offer discount codes, promotional pricing, bundles, gifts with purchase, or other promotional offers.
Unless expressly stated otherwise, promotions cannot be combined with other offers.
Promotional codes have no cash value and cannot be redeemed for cash.
Discounts cannot be applied retroactively to completed purchases unless expressly stated otherwise.
Promotions may be subject to product, customer, geographic, quantity, or time restrictions and may be available only while supplies last.
We reserve the right to modify or end promotions as permitted by law.
We may cancel an order involving unauthorized, fraudulent, or abusive use of a promotional offer.
10. SHIPPING
Shipping availability, processing times, delivery estimates, shipping rates, international shipping, and related delivery terms are governed by our Shipping Policy, which forms part of these Terms.
Customers are responsible for providing complete and accurate shipping information when placing an order. Delivery times are estimates and may be affected by carriers, customs, weather, transportation disruptions, or other circumstances outside our reasonable control.

11. INTERNATIONAL ORDERS
International orders may be subject to customs duties, taxes, brokerage charges, import fees, or other charges imposed by the destination country or applicable authorities.
Unless expressly collected by The Memry at checkout, these charges are the responsibility of the customer.

12. RETURNS AND REFUNDS
Returns, refunds, damaged products, missing items, return eligibility, and related requirements are governed by our Return & Refund Policy, which forms part of these Terms.
Returns and refunds are subject to the eligibility requirements outlined in our Return & Refund Policy. Products that have been opened, tested, sprayed, used, or otherwise altered are not eligible for a standard return, except where required by applicable law or in cases involving damaged, defective, or incorrect products.
13. CUSTOMER ACCOUNTS
Customers may create accounts on The Memry website to facilitate purchases and access certain account features.
You are responsible for maintaining the confidentiality and security of your account credentials.
You are responsible for activity conducted through your account unless otherwise provided by applicable law.
Information supplied through your account should be accurate and current.
We may restrict, suspend, or terminate accounts that are used fraudulently, unlawfully, or in material violation of these Terms.
14. REVIEWS AND CUSTOMER CONTENT
The Memry may allow customers to submit reviews, ratings, photographs, videos, comments, and other content.
Our review functionality may be provided through Judge.me or another service provider.
When you voluntarily submit content for publication, you represent that you have the right to provide that content and that it does not violate another person's intellectual property, privacy, publicity, or other legal rights.
You grant The Memry a non-exclusive, worldwide, royalty-free license to display, reproduce, format, and use content that you voluntarily submit in connection with operating, promoting, and improving The Memry and our products, subject to applicable law and our Privacy Policy.
We may decline or remove content containing spam, unlawful material, threats, personally identifying information, fraudulent content, or material unrelated to the relevant product or customer experience.
We do not require customer reviews to be positive.
15. INTELLECTUAL PROPERTY
The Memry website and its original content, including The Memry name, logos, branding, original product names, photography, graphics, packaging artwork, website design, written descriptions, videos, and other creative materials, are owned by or licensed to The Memry or Metrosel Inc., as applicable.
Our content may not be copied, reproduced, republished, distributed, sold, commercially exploited, or used to create confusingly similar branding without authorization, except as permitted by law.
Any third-party names, trademarks, or intellectual property referenced on our website remain the property of their respective owners.

Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited by law.
24. INDEMNIFICATION
To the extent permitted by applicable law, you agree to indemnify and hold harmless The Memry and Metrosel Inc. from third-party claims arising directly from your unlawful use of our website, material violation of these Terms, or infringement of another person's rights.
